Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Stance, an app operated by Tony Nguyen as a sole proprietor (“Stance,” “we,” “us”) governing your use of the Stance application and website (the “Service”). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service. This is the end-user license agreement (EULA) for the App.

Health disclaimer — please read. Stance is a general wellness and educational tool. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or condition. The posture scan provides an estimate of postural alignment for informational and motivational purposes only — it is not a medical diagnosis and is not a substitute for evaluation by a licensed clinician. Consult a qualified healthcare professional before beginning any exercise program, especially if you are pregnant, recovering from injury or surgery, or have a medical condition. Stop and seek medical care if you experience sharp or radiating pain, numbness, tingling, weakness, dizziness, loss of coordination, balance or gait problems, or bowel/bladder changes. If you think you have a medical emergency, call your local emergency number. Results vary.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service, and you confirm you meet that age. If you are a minor, you must have your parent or guardian’s permission.

2. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or distribute the App except as allowed by law.

3. The Service & assumption of risk

The Service estimates posture from a photo using on-device analysis and suggests general corrective exercises and habits. Exercise carries inherent risks. You are responsible for exercising within your own limits and stopping if anything hurts. By using the Service you knowingly and voluntarily assume all risk of injury arising from performing any exercise or following any suggestion in the App, to the fullest extent permitted by law.

4. Subscriptions, free trials & auto-renewal

Stance offers auto-renewable subscriptions. Current options and prices are shown in the App and may include a weekly, monthly, annual (with an optional free trial), and a one-time lifetime purchase.
Payment is charged to your Apple ID account at confirmation of purchase.
Auto-renewal: a subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
Free trial: if you start a free trial, any unused portion is forfeited when you purchase a subscription. Payment begins at the end of the trial unless you cancel at least 24 hours before it ends.
Manage/cancel anytime in your device’s App Store account settings. Deleting the App does not cancel a subscription.
Refunds are handled by Apple under the App Store Terms; we generally cannot issue refunds directly.

5. Acceptable use

You agree not to misuse the Service, including by attempting to disrupt it, access it unlawfully, or use it to harass, harm, or rate or objectify other people. The Service scores posture for wellness; it is not a tool for rating people’s appearance or attractiveness.

6. Intellectual property

The Service, including its software, design, text, and the “Stance” name and logo, is owned by us or our licensors and is protected by law. These Terms grant you no rights to our trademarks or branding.

7. Disclaimers of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that posture estimates are accurate, that the Service will be uninterrupted or error-free, or that following the Service will produce any particular result.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STANCE AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold Stance harmless from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

10. Apple-specific terms

These Terms are between you and Stance only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App (including product-liability, legal/regulatory, or consumer-protection claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable consumer-protection law provides otherwise.

12. Changes

We may update these Terms; material changes will be reflected by the “Last updated” date and, where appropriate, in-app notice. Continued use after changes means you accept them.
